Terms of Use
Policies
Thank you for choosing to advertise your business on Mamahood’s vibrant social media platform. We appreciate your understanding that advertising is essential for gaining exposure and growing your business. Please take a moment to read through Mamahood’s Advertising Policy to ensure a great experience!
Accepting these Terms
By subscribing to one of Mamahood’s advertising packages and utilizing your advertising benefits, you agree to comply with these Terms. This agreement outlines your rights and responsibilities as a Mamahood Trader and constitutes a legally binding contract between you and Mamahood (Pty) Ltd.
Amendment of Terms
We may occasionally amend these Terms. Your continued use of Mamahood’s services after any changes indicates your acceptance of the updated Terms. Amendments will take effect once posted on the Mamahood website. It is your responsibility to familiarize yourself with these Terms and review any amendments.
Advertising Requirements
To subscribe to Mamahood’s advertising packages, you must meet the following criteria:
- Be 18 years or older.
- Operate a business that services South African residents.
Advertising Subscriptions
We offer two advertising options: You Advertise and We Advertise. You can choose to manage your advertising or have Mamahood do it for you.
1) SUBSCRIPTION REGISTRATION
To register for your subscription, you must complete the subscription checkout form. This form requires you to provide your business name, contact information, and banking details.
If your payment through Payfast is unsuccessful during registration, you will be enrolled in a recurring debit order for payment.
All debit orders take place on the last working day of the month.
2) SUBSCRIPTION RENEWALS
All subscriptions are set to automatically renew on a monthly or annual basis, depending on your chosen plan. If you do not cancel your subscription before the renewal date, it will be renewed automatically, and no refunds will be issued.
Please note that our system does not send reminders prior to the renewal date. We strongly encourage you to keep track of your subscription start date and the renewal date to avoid any unexpected charges.
3) PAYMENT DATE
Your sign-up date will be your payment date. If you are on a debit order, your invoice date will remain the same, but your account will be charged on the last working day of the month.
4) MANAGING YOUR SUBSCRIPTION
You can manage your subscription on the Mamahood website. Find the link to the Manage page on the homepage.
You can upgrade or downgrade between the two advertising options, You Advertise and We Advertise, and changes will take effect immediately.
You can update your account once a month. If you try to update again within the same month, the change will only apply the following month.
You can also cancel your contract on the Manage page. Please see the cancellation procedure below.
Advertising Guidelines
1) ADVERTISING GUIDE
After subscribing, you will receive an email with a link to Mamahood’s Advertising Guide, which includes guidelines and tips for maximizing your advertising potential.
2) HOW CAN YOU ADVERTISE?
Depending on your chosen option, you can either advertise yourself or have Mamahood advertise for you.
2.1) ADVERTISING YOURSELF
With this option, you are responsible for scheduling and managing all your posts on Mamahood’s social media platforms. You must join the relevant groups provided in the Advertising Guide. If you do not utilize this service, it will not affect your advertising fee.
2.2) MAMAHOOD ADVERTISES FOR YOU
With this option, Mamahood will manage all your advertising needs.
You are responsible for providing the necessary information for us to create marketing posts, which will be shared in applicable Mamahood Facebook groups 3 to 4 times a week. Mamahood does not post on weekends or public holidays.
Please note that if you do not send us your information, we cannot be held responsible for any missed postings.
3) WHAT CAN YOU ADVERTISE?
You may only advertise products and services related to your registered business. Posts unrelated to your business will not be allowed.
3.1) BUSINESS TYPES WITH SPECIAL REQUIREMENTS
Below are the business types that require special provisions in order to advertise on the Mamahood social media platform:
- Non-Profit Organizations (NPOs)
You can advertise your organization on the Mamahood social media platform, but all posts must focus solely on your NPO and cannot ask for money. You can direct our members to your charity profile on the Mamahood website for donations. - Second business
You can only advertise services or products related to the business subscribed to our advertising service. If you offer multiple unrelated services, you’ll need to subscribe a second business to the service. - Head office with branches, representatives or coaches
All businesses with a head office and branches, representatives, or coaches in different areas must subscribe separately to the advertising service. The head office can promote the overall brand, while each branch or representative can advertise their specific services and contact details. - Marketing Companies
Marketing companies can subscribe to the advertising service and promote their services on the Mamahood social media platform. However, to promote a business that uses your services, that business must first register as a Trader on the Mamahood website and subscribe to the advertising service. They will also need to notify us that you will manage their advertising.
- Directories and multi-vendor stores
Mamahood does not allow directories, multi-vendor stores, or similar business formats to subscribe to our advertising service or promote their business on our social media platform. We reserve the right to decline your subscription and refund any advertising fees paid.
3.2) INELIGIBLE PRODUCTS, SERVICES AND DOWNLOADS
If you try to advertise products or services on Mamahood Market that we believe could harm our community, don’t align with our values, or go against the spirit of Mamahood, we can stop you from advertising those items on our social media.
3.3) DONATION REQUESTS
If you try to advertise products or services on Mamahood Market that we believe could harm our community, don’t align with our values, or go against the spirit of Mamahood, we can stop you from advertising those items on our social media
4) WHEN CAN YOU ADVERTISE?
4.1) WHEN YOU ARE ADVERTISING
You can start advertising once you receive confirmation from us that your registration has been processed, which can take up to 2 working days. After that, you can post in all relevant Mamahood groups as often as you like (we suggest 2 to 3 times a day), every day of the week.
Please note that all posts in our Facebook groups need admin approval before they go live. This helps us control what gets posted and ensures that only subscribers can advertise. Our admin team prioritizes approving posts from Traders.
Admin approval hours are from 8 am to 8 pm. Posts made after 8 pm will be approved the next morning.
If you consistently follow the posting guidelines, you may receive pre-approval status, allowing your posts to go live automatically. However, if you violate our guidelines while on pre-approval, we will revoke that status, and your posts will need admin approval again.
4.2) WHEN MAMAHOOD ADVERTISES
If you choose the Mamahood advertising on your behalf option, we will create advertising posts for you 3 to 4 times a week. Please note that Mamahood does not post on weekends or public holidays.
5) WHO CAN ADVERTISE YOUR BUSINESS?
When you subscribe to our advertising service, we will share your name and business name with our admin for post approval. If you post under a different name, please inform Mamahood.
If someone else, like a colleague or marketing agency, will post for you, provide their details to avoid any restrictions on your ads. Each account can have up to 5 posters. If you need more, you must register a second subscription.
Mamahood is a platform for moms, so only women can join our regional advice groups on Facebook. Men can still use our advertising service, but all ads in the Mamahood groups must be posted by a female colleague or through your business profile. Many male-owned businesses are successfully advertising this way. Our Mamahood South Africa group welcomes both men and women to promote their businesses.
6) WILL MAMAHOOD DO ANY ADVERTISING FOR ME?
Mamahood may choose to feature your business on our social media channels, such as our Facebook and Instagram pages. This is separate from the advertising service for Traders who have signed up. We do not charge for these featured posts and do not accept requests to feature your business.
7) REMOVAL OF ADS
Mamahood can reject or remove any ad at our discretion, especially if it harms our relationships with members or partners. Policy decisions are complex, and we consider various factors to determine what’s best for our community.
Payment Obligations
By subscribing, you agree that this is an automatically renewing contract and that you will continue to honour your payment obligations for your advertising fees until you cancel your subscription. If your subscription is renewed for another term, you are responsible for making the necessary payments.
If you default on your payments, your account and profiles may be suspended from Mamahood Facebook groups for up to 28 days.
We also reserve the right to switch your payment method between our PayFast subscription system and our Netcash debit order system to recover any outstanding fees.
Intellectual Property
All wording and images used in your advertising posts must be original content.
At Mamahood, we respect your intellectual property and will remove any content that infringes on your rights from our Facebook groups. If you see content that you own being used without your permission, please report it to us for removal.
If you post content that violates someone else’s intellectual property, we will remove it and issue a warning. Repeated violations may lead to account termination.
Professional Business Practises
Mamahood connects members with creative local businesses from diverse backgrounds. Our goal is to build a community that inspires, fosters connections, and nurtures entrepreneurial relationships. We want everyone to have a positive experience on our website and Facebook groups.
We take pride in creating a professional environment with trustworthy Traders who provide quality service and products. All Traders are expected to conduct themselves professionally in the Mamahood Facebook groups. If any Trader engages in behavior that negatively impacts others or harms the Mamahood brand, we reserve the right to remove them and suspend their advertising benefits.
Cancellation
1) CANCELLATION BY TRADER
You can manage your own subscription and cancel our social advertising services at any time. To cancel, you must submit a Cancellation Request Form from the Manage page on the Mamahood website—this is the only way to cancel your subscription.
Since you handle your own subscription, an email stating your intent to cancel is not sufficient.
Because this is an auto-renew system, it’s your responsibility to cancel before the next term starts. Once the new term begins, you cannot cancel the previous term or request a refund for any remaining time.
Cancellations take 24 hours to process, so your cancellation will take effect 24 hours after you submit the form. Please make sure to cancel at least 2 days before your next invoice date to avoid incurring more fees on your account.
1.1) CONFIRMATION OF CANCELLATION
After you submit your cancellation form, you will receive an email from Mamahood confirming that your cancellation has been received. From that point on, you will not incur any new charges on your account.
1.2) OUTSTANDING BALANCE ON YOUR TRADER ACCOUNT
To finalize the cancellation of your advertising subscription with Mamahood, you must pay all outstanding fees. If you submit a cancellation but still owe money, your cancellation will be logged, and you won’t incur further charges, but it won’t be finalized until your balance is paid.
Mamahood will keep charging your account for any outstanding balance using all payment methods on file, including PayFast payments from your card and Netcash debit orders from your bank accounts until all fees are fully paid. We reserve the right to take action to recover any owed amounts after giving you a 30-day notice.
1.3) DEBIT ORDER SYSTEM CANCELLATIONS
Debit orders from Mamahood run on the last working day of each month. To ensure your debit order is processed, we must submit the batch by the 25th of each month. Therefore, we cannot accept cancellations between the 25th and the end of the month. Cancellations during this time will be treated as received on the 1st of the following month, and the debit order for your monthly advertising fee will still be processed.
If you use a debit order payment system, there may be a delay between your invoice date and when your bank account is debited. This means you might have an outstanding invoice when you cancel, and that fee will still be charged at the end of the month. Your cancellation will only be finalized once all fees are paid.
Please be aware of your invoice date to know when your term renews.
1.4) CANCELLATION OF PAYFAST SUBSCRIPTION BY TRADER
Please note that cancelling your PayFast subscription does not terminate your advertising contract. By subscribing to the Mamahood advertising service, you agree to allow us to use the banking details you provided upon sign-up to debit your account for your monthly fee and any outstanding balances.
1.5) STOPPED PAYMENTS
Stopping a payment on your debit order violates your agreement with Mamahood and is considered a breach of contract. We reserve the right to take action for any breaches related to stopped payments.
You will be charged a R120 stopped payment fee, which will be added to your account along with any outstanding fees. Stopping a payment does not count as a cancellation; you must follow the full cancellation procedure.
Mamahood will continue to charge your account for any outstanding balance using your all payment methods on record until all fees are settled.
1.6) TRANSFERRING OWNERSHIP
You cannot transfer your Mamahood contract rights and obligations to anyone else without our prior written consent. If you sell your business and the new owner wants to continue under your current subscription, please email Mamahood at listings@mamahood.co.za.
The transfer will only be successful once the new owner accepts the Advertising Policy, at which point you will be released from your contract.
2) CANCELLATION BY MAMAHOOD
The following instances will result in Mamahood cancelling your advertising subscription to the Mamahood social media platform:
- If we receive regular complaints about your business and the quality of service you provide.
- If you are behind in your advertising fees and have an outstanding balance owed to Mamahood, Mamahood’s services are conditioned upon the fulfilment of your payment obligations.
- If you make advertising posts that are not within the advertising guidelines as outlined in this Advertising Policy.
- If you make advertising posts for the sale of any other products or services that are not directly related to the business you have registered with Mamahood.
- If your behaviour as a Trader brings the Mamahood’s name into disrepute.
Disputes
If you have a dispute or claim about the fees charged, you must email Mamahood at listings@mamahood.co.za within 45 days of the invoice date. Please include all relevant details in your email.
If you do not follow this procedure, Mamahood may reject your claim without any further obligation.
Agreement & Mandate
I authorise Mamahood to issue payment instructions to my bank for collection from the bank account specified above, provided that the total amount does not exceed my obligations as outlined in the Agreement, including any additional fees. I agree to begin this contract on the start date and continue until I cancel this authority and contract in accordance with Mamahood’s cancellation policy.
I acknowledge that all payment instructions issued by Mamahood will be treated by my bank as if I issued them personally. I understand that cancelling this authority does not cancel the Agreement, and I will not be entitled to a refund for any amounts withdrawn while this authority was active, as long as those amounts were legally owed.
I confirm that all banking information provided is accurate and that I have the legal authority to authorise the necessary payment instructions from this account. I understand that the withdrawals will be processed through a computerised system provided by South African Banks. I agree to all terms stated in this policy and commit to upholding this agreement.
